1. Terms and Conditions
1.1 Introduction
These Terms and Conditions ("Terms") govern your use of the Aemyon Wave platform suite, including TicketWave, StockWave, and BoardWave (collectively, the "Services"), operated by Aemyon ("we", "us", "our"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Services.
1.2 Service Description
Aemyon Wave provides a suite of management tools designed for teams, logistics, and projects. The platform includes:
- TicketWave — Team and credential management
- StockWave — Inventory and logistics tracking
- BoardWave — Project and task management
1.3 User Responsibilities
As a user of the Services, you agree to:
- Provide accurate, current, and complete information during registration and form submissions
- Maintain the confidentiality of your account credentials
- Not use the Services for any unlawful purpose or in violation of any applicable laws
- Not attempt to gain unauthorized access to any part of the Services
- Notify us immediately of any unauthorized use of your account
1.4 Intellectual Property
All content, features, and functionality of the Services — including but not limited to text, graphics, logos, icons, images, software, and the underlying code — are the exclusive property of Aemyon and are protected by international copyright, trademark, patent, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Services without our express written permission.
1.5 Disclaimer of Warranties
The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, we disclaim all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components. Nothing in this section limits any rights you have as a consumer under mandatory law.
1.6 Limitation of Liability
To the maximum extent permitted by applicable law, Aemyon shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Services. Our total aggregate liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
1.7 Termination
We may terminate or suspend your access to the Services at any time, with or without cause, with or without notice. Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
1.8 Governing Law
These Terms shall be governed by and construed in accordance with the laws of Portugal. Any disputes arising from or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Portugal. If any provision of these Terms is held to be unenforceable or invalid, the remaining provisions will continue in full force and effect.
1.9 Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last updated" date at the top of this page. Your continued use of the Services after any changes constitutes your acceptance of the updated Terms.

2. Privacy Policy
2.1 Data Controller
Aemyon is the data controller responsible for your personal data. If you have any questions about this Privacy Policy or our data practices, you can reach us at:

2.2 Data We Collect
When you submit our contact form, we collect the following personal data:
- Identity data: First name, last name
- Contact data: Email address, phone number
- Business data: Company name, number of employees, sector of activity, country
- Inquiry data: Additional details about your business needs
- Consent data: Your acceptance of terms and marketing email preferences
When you subscribe to our newsletter (via the sign-up form in the site footer, or by ticking the marketing box on the contact form), we collect:
- Contact data: Your email address, and your first name if you also submitted the contact form
- Proof of consent: The date and time you subscribed, where you subscribed from, and the IP address used — retained so we can demonstrate that consent was given, as required by GDPR
We do not use analytics, advertising, or tracking services, and we do not build behavioural profiles of visitors.
2.3 Purpose & Legal Basis
We process your personal data for the following purposes and legal bases:

2.4 Marketing Communications
We will only send you marketing emails if you have explicitly opted in, in one of two ways:
- By entering your email into the newsletter sign-up form in the site footer
- By ticking the optional marketing consent checkbox on our contact form — this box is never pre-selected and is not required to submit the form
We do not sell, rent, or share the marketing list with anyone. Every marketing email we send contains a one-click unsubscribe link and a standard List-Unsubscribe header, so your mail client can also unsubscribe you directly. Unsubscribing takes effect immediately and removes you from all future campaigns. You can also withdraw consent at any time by writing to contact@aemyon.com. Transactional emails — such as the confirmation of a contact form submission or a reply from our team — are not marketing and are not affected by unsubscribing.
2.5 Data Retention
We retain your personal data for as long as necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law. Specifically:
- Contact form submissions: Retained for up to 3 years from the date of submission, or until you request deletion
- Marketing consent records: Retained as long as consent is active, plus 1 year after withdrawal for compliance documentation
- Unsubscribed addresses: Kept on a suppression list so that we do not email you again by mistake — you may request full deletion instead
2.6 Third-Party Sharing
We do not sell your personal data. We may share your data with the following categories of third-party service providers, solely for the purposes described in this policy:
- Email service providers (SMTP2GO) for sending transactional and marketing emails
- Database hosting providers (MongoDB Atlas) for secure data storage
- Website hosting providers (Microsoft Azure Static Web Apps) for serving this website
- Bot protection providers (Cloudflare Turnstile) for verifying that form submissions come from a person and not an automated script
Each of these providers acts as a processor on our instructions and is bound by a data processing agreement.
2.7 Your Rights (GDPR)
Under the General Data Protection Regulation (GDPR), you have the following rights regarding your personal data:
- Right of access: Request a copy of the personal data we hold about you
- Right to rectification: Request correction of inaccurate or incomplete data
- Right to erasure: Request deletion of your personal data ("right to be forgotten")
- Right to restrict processing: Request limitation on how we process your data
- Right to data portability: Receive your data in a structured, machine-readable format
- Right to object: Object to the processing of your data for certain purposes
- Right to withdraw consent: Withdraw your consent for marketing communications at any time

2.8 International Data Transfers
Some of the providers listed in section 2.6 are based outside the European Economic Area, or may process data outside it. Where personal data is transferred outside the EEA, we rely on the safeguards permitted under Chapter V of the GDPR — principally the European Commission's Standard Contractual Clauses, together with the provider's own supplementary technical measures. You may request a copy of the safeguards applied to a specific transfer by contacting us.
2.9 Data Security
We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction. These measures include encryption in transit (TLS/SSL), secure database access controls, and regular security reviews. However, no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee absolute security.
